Waiver and Release of Liability, and Acknowledgment and Assumption of the Risks of Serious Bodily Injury, Death, and Property Damage.
WARNING! Read this waiver carefully before agreeing to it. This document is a release of liability and waiver of your legal rights and the legal rights of your minor(s). Do not sign this document unless you have read and understood it in its entirety as you will be held to have read and understood it.
WAIVER. In consideration of admission to The Adventure Lagoon, I, the undersigned adult listed below, acknowledge that I am at least 18 years of age, and I agree and understand that The Adventure Lagoon and its attractions carry certain inherent risks, including but not limited to the risk of SERIOUS BODILY INJURY or DEATH. I further understand that The Adventure Lagoon and its attractions will be shared with others over whom Anaheim Adventure Park, LLC has no control.
I, on my own behalf and on behalf of the above-listed minors, as their parent or legal guardian, voluntarily acknowledge and assume all risk of serious bodily injury, death, or property damage, both known and unknown, however caused, from use of The Adventure Lagoon, even if caused in whole or in part by the action, inaction, or negligence of Anaheim Adventure Park, LLC, its members, principals, officers, employees, equipment manufacturers, and repair persons, or the Orange County Water District, its officers, directors, employees, representatives, agents and volunteers (collectively, "the Released Parties"). Such risks include but are not limited to drowning, broken bones, spinal injuries, cuts, bruises, blindness, infection from COVID-19 and other viruses, bacteria and pathogens, allergic reactions, heart attack, stroke, brain damage, waterborne illnesses, disease, poisoning, and other means of serious bodily injury or death.
I, on my own behalf and on behalf of the above-listed minors, as their parent or legal guardian, expressly waive any and all claims, lawsuits, demands, or complaints for personal injury, death, property damage, or other loss or injury as against the Released Parties and each of them, including but not limited to any and all negligence, negligent supervision, negligent hiring and negligent instruction. This waiver is intended to be a complete release of the Released Parties for any and all responsibility for personal injury, death, or property damages sustained by me or any of the below-listed minors relating in any way conceivable to entry or use of The Adventure Lagoon. This release is binding on the heirs, representatives, and estates of the undersigned and the below-listed minors.
Authorization to Use Image and Personal Information. The Released Parties are hereby granted the right to use any image and personal information of the undersigned and below-listed minors in any social media, websites or other marketing materials.
I, for myself, and as parent or legal guardian of the minors listed above, have read and understand all written or posted safety rules and conditions for attendance at The Adventure Lagoon, participation in activities, and use of any equipment or attractions, and I shall obey and comply with such rules and conditions and ensure that my minor child obeys and complies with such rules and conditions. I understand that failure to obey and comply with all rules and conditions may result in ejection from The Adventure Lagoon. I represent to Released Parties that I and the below-listed minors are physically and mentally able to safely participate in the activities at The Adventure Lagoon, and use of The Adventure Lagoon.
This basin is filled with purified recycled water. Do not drink.
NOTICE: By signing this document you assume all risk of injury or damage to yourself and the below-listed minor(s) and release the Released Parties from all liability to the fullest extent permitted by law.
